Voici un peu plus de quarante ans était adoptée la première directive concernant le rapprochement des législations des Etats membres relatives au maintien des droits des travailleurs en cas de transferts d'entreprises, d'établissements ou de parties d'établissements. La réalisation du marché commun et la suppression des entraves au commerce et à la concurrence sur le territoire européen avait entraîné d'inévitables restructurations d'entreprises en raison de la concurrence accrue entre elles. Quarante ans plus tard, la question du statut des travailleurs en cas de transfert d'entreprise continue de se poser régulièrement. Et elle se pose de manière partiellement différente selon les Etats. L'objet ce dossier est de s'interroger sur la validité de différents droits nationaux (et notamment les droits belge, espagnol, français, italien et luxembourgeois) au regard du droit de l'Union européenne dans ce domaine précis, que ces transferts soient dits conventionnels ou concernent une entreprise en difficulté. Les développements récents de la jurisprudence de la Cour de justice et l'entrée en vigueur de la Charte des droits fondamentaux de l'Union européenne rendent cette interrogation indispensable.
