Le droit administratif est l'héritier d'une longue histoire qui commence il y a longtemps sous l'Ancien Régime ; il a été conforté avec la création du juge administratif sous l'Empire. Leur sort a été lié jusqu'à aujourd'hui. Le droit administratif que nous connaissons est largement l'oeuvre du juge et si ce dernier a souvent été contesté, il s'est progressivement imposé au point qu'il paraît difficile d'envisager sa suppression. Mais le droit administratif n'est plus, ou plus seulement, lié au juge administratif, les transformations de toutes sortes qu'il a connues depuis plus d'un demi-siècle le changent en profondeur.
