L’Opera offre una rinnovata sistematizzazione delle figure di bancarotta fraudolenta patrimoniale attraverso l’innesto della ‘crisi’ quale elemento costitutivo implicito del tipo. Centrale l’idea secondo cui alla funzionalizzazione del diritto concorsuale (ora compendiato nel d.lgs. 14/2019) alla conservazione e al rilancio dell’impresa, intesa come valore, non possa rimanere insensibile l’appendice penalistica, previamente analizzata sul duplice fronte del diritto vigente e del diritto ‘vivente’. Da qui l’urgenza – logica e assiologica – di sintonizzare il tessuto repressivo, pure formalmente immutato, sul nuovo quadro di contorno: l’elevazione della ‘crisi’ a presupposto del reato, spia del disvalore di contesto in cui si ambientano le condotte tipiche di bancarotta fraudolenta patrimoniale, rinsalda la razionalità di sistema e il rispetto dei principi non flessibili del diritto penale, infine verificati nel raffronto con le figure di bancarotta semplice e di bancarotta di evento che completano il versante penale del diritto dell’insolvenza.
