Le droit international privé est confronté depuis près de trois décennies à un phénomène d'ampleur pour lequel il n'avait pas été pensé à l'origine : l'internet. À travers le réseau des réseaux, la discipline fait face à deux défis de taille, l'immatérialité et l'universalité des activités en ligne. À défaut de pouvoir localiser l'activité en ligne avec certitude, comment déterminer l'ordre juridique le plus proche de la situation ? L'adaptation des règles du droit international privé au contexte de l'internet, en l'absence d'intervention du législateur, incombe au juge. L'entreprise n'est toujours pas achevée et ses résultats demeurent pour l'instant largement insatisfaisants. On observe notamment une jurisprudence qui tend à limiter les inconvénients liés à la plurilocalisation des activités en ligne au moyen d'une approche dite « mosaïque », ce qui n'est autre qu'un retour au territorialisme le plus strict dans le cadre d'un réseau que l'on prétend pourtant a-territorial. Les défauts techniques de cette approche sont patents, en particulier du point de vue de la prévisibilité des solutions. Face au problème persistant de l'internet, on pourrait songer à mettre en oeuvre une solution radicale : se concentrer uniquement sur la situation géographique des parties et, plus spécialement, sur le pays d'établissement du demandeur. Il apparaît en effet plus simple de localiser l'une des personnes impliquées dans l'activité en ligne, plutôt que l'activité en elle-même. La solution, toutefois, ne permet pas de concilier l'ensemble des intérêts en présence. La conciliation du droit international privé avec l'internet serait mieux réalisée en empruntant une autre voie, plus respectueuse du principe de proximité. Cette voie réside dans la prise en compte du lieu où l'activité en ligne litigieuse a son « impact le plus significatif », cela afin de localiser la situation juridique et de déterminer le droit applicable ou les juridictions compétentes. Reste encore à préciser comment identifier celui-ci. Les nouveaux outils de mesure d'audience géographique, à cet égard, peuvent jouer un rôle déterminant. L'ouvrage revient sur certains concepts-clés de la théorie générale du droit international privé, comme la localisation matérielle ou le principe de proximité, afin de formuler des solutions concrètes dans le domaine des activités en ligne.
