Die Debatten um die erste brasilianische Verfassung sind von dem außergewöhnlichen Weg Brasiliens in die Unabhängigkeit geprägt. Anfang des 19. Jahrhunderts war Brasilien Regierungssitz des lusitanischen Reiches. Bald darauf wurde es Portugal rechtlich gleichgestellt. Durch die portugiesische Revolution im Jahr 1820 drohten diese Errungenschaften wieder verlorenzugehen. Mit der Unabhängigkeit im Jahr 1822 wurde Brasilien ein konstitutionelles Kaiserreich mit dem portugiesischen Thronfolger an der Spitze. So sollte der Status quo erhalten bleiben. Das Verfassungsprojekt der Verfassungsgebenden Versammlung scheiterte, stattdessen wurde ein Verfassungsoktroi erlassen.

Die Autorin untersucht die Diskussionen in der Verfassungsgebenden Versammlung und den öffentlichen Diskurs um die Verfassungsgebung. Ferner prüft sie den Einfluss europäischer Verfassungen auf das Verfassungsprojekt und das letztlich erlassene Verfassungsoktroi.
