Gli anni che stiamo vivendo e quelli appena trascorsi hanno segnato, come si usa dire, un mutamento radicale della nostra vita, del nostro modo di operare e di costruire relazioni. Ma non solo. La crescita dirompente delle piattaforme digitali e del loro potere così come l’inarrestabile conquista dei mercati, da quello finanziario a quello dei trasporti a quello alimentare, ha costretto gli operatori economici nonché i regolatori e i legislatori a confrontarsi con le nuove tecnologie e con l’intrinseca capacità di modificarsi costantemente. In un primo momento il loro impatto sulla economia e sulla società era ancora per qualche aspetto non del tutto conosciuto. Il concetto di “disruptive innovation” ricorreva nella letteratura proprio per identificare i nuovi modelli di business e i nuovi strumenti che cominciavano a sradicare l’economia tradizionale e la regolazione dell’era pre-digitale che mostrava la sua fragilità nell’impatto con gli algoritmi. Di fronte alla smisurata crescita della dipendenza dalla tecnologia e dal software come elemento di costruzione, organizzazione e conformazione delle relazioni interpersonali e delle transazioni commerciali diviene sempre più evidente che nel mondo digitale il codice sta rimpiazzando le tradizionali funzioni del diritto.
