D'après la 4e de couv. : " "Milice multicolore et sans patrie" : selon les mots de Gambetta, les congrégations religieuses qui ont su se reconstituer après la tempête révolutionnaire, sont perçues, en cette fin de XIXe siècle, comme un obstacle à l'enracinement de la Troisième République. En digne fille de la Révolution, celle-ci entend bien faire taire les ambitions de l'Église et de ses soldats congréganistes. C'est par la force de la loi que les républicains espèrent parvenir à cet objectif. Ce programme, débuté dès 1879, va rapidement trouver ses opposants. Parmi eux, des juristes catholiques vont se grouper pour diriger la défense sur le terrain du droit : c'est ainsi que naît, en 1880, le "Comité de jurisconsultes des congrégations". Réunissant praticiens et universitaires, ce Comité, dirigé par le baron Armand de Mackau, figure emblématique de la droite, se tindra aux côtés des congrégations pendant près de vingt-cinq ans, luttant "la loi à la main" pour leur offrir, à l'échelle nationale, un extraordinaire service d'assistance juridique, qui s'avèrera en réalité être bien plus que cela. Droit civil, pénal, administratif, fiscal, ou encore droit des sociétés, peu de domaines échappent à son examen. Prétendant à une expertise neutre, dégagée de toute considération politique, ce Comité constitue un observatoire intéressant pour analyser l'enchevêtrement du juridique et du politique. Si le conflit entre les congrégations et la République demeure bien souvent examiné exclusivement sous un prisme politico-religieux, la découverte du fonds d'archives du "Comité Mackau" ouvrait dès lors une porte nouvelle sur la résistance juridique à laquelle cette bataille a donné lieu. À partir de là, s'imposait donc de repenser le problème sous un angle nouveau : celui d'un militantisme juridique catholique. Cette étude tend donc à examiner la manière dont ces juristes catholiques se sont emparés du droit comme arme de revendication, comme instrument de défense d'une cause et comme mode de protestation contre la politique anticongréganiste menée de 1880 à 1905. Cette histoire est ainsi celle d'un combat mené "avec foi et loi" par des hommes déterminés à mettre la science du droit au service de la cause religieuse".
