Dalla fine dell'ottocento l'"anticipazione bancaria" suscita l'interesse di dottrina e giurisprudenza decise ad individuare-qualificare il tipo contrattuale di una fattispecie, orfana di definizioni normative ma presente nella prassi bancaria sin dal IX secolo. Il dibattito dottrinario sulla natura dell'anticipazione bancaria persiste anche dopo la sua sistematizzazione nel codice del 1942. Gli articoli ad essa dedicati, infatti, ereditano le incertezze ed i dissidi interpretativi dei suoi primi commentatori, riluttanti all'adozione di una normativa puntuale dei contratti bancari. Attraverso un'analisi critica e aggiornata delle norme che configurano la fattispecie lo studio esamina approfonditamente i caratteri che la connotano quali, tra gli altri, la "regola dello scarto"; studia la compatibilità dell'anticipazione bancaria con le nuove forme di garanzia, sgrossandola dalla sovrapposizione di norme mutuate da istituti affini, con lo scopo ultimo di restituire contemporaneità ad uno strumento che conserva intatta la sua ratio più che mai attuale di risoluzione del contrasto tra l'esigenza di circolazione dei beni e la tutela del creditore.
